Jonathan Miller is here to talk about his new podcast, hemp, legally speaking. Jonathan, welcome to the show. It's great to be with you, Dan. I'm glad you could join us today. , and I'm even more glad that you decided to share your hemp expertise with the rest of the world.
I know you're the general counsel of the U S hemp brown table. But since we last spoke, I believe you were named member in charge of your law firms, Washington office, with so much on your plate. What prompted you to start a podcast? Well, I have been advocating for hemp for about a decade and representing clients who want to navigate the labyrinth and rules and regulations and laws of hemp.
And I've been so active publicly when it comes to the advocacy side and engaging the public. And hemp supporters and have businesses and [00:01:00] CBD companies when it comes to trying to change legislation, but really have not been public facing when it came to what do these laws mean?
How can I start a business? How can I. To trademark, how can I comply with the laws? I'm a recovering politician. I was the state treasurer of Kentucky for a couple of terms. And I was out of , the practice of law for nearly two decades. I didn't start becoming a real lawyer again until I was 43.
And my joke, although it is a bit serious. I had to invent a whole new area of the law in order to practice it. And so that's, what's happened. , I've been helping write these laws and regulations and, lobbying for them and helping with the drafting. And so I've got this really unique position of being able to advise people on what they mean.
And, that kind of expertise is what I'm hopeful to share with our listeners. Like you said, you know, this stuff, but a lot of it isn't getting disseminated out or explained how it will affect people and your show premiered in July. So you're really [00:02:00] just getting started in this.
Who's your target audience and why should they. Well, my target audiences are those companies that are in the hemp space and they might be a CBD manual or a retailer of hemp products or someone who is a processor and sometimes it may be a farmer who's looking to get into the business or looking to expand.
There are business opportunities. And so our goal is to really empower them, to be able to get off to a hot start for your business raise the kind of money you need to capitalize, avoid the pitfalls of what the laws and regulations mean and meet these kinds of technical issues.
folks have to deal with every day, you know, do I want to protect , my name through a trademark? Do I want to ensure that the labels on my products are meeting with the , FDA is going to be looking for, and so that's what we're hoping to accomplish. Yeah. Those are a lot of really pressing [00:03:00] topics that unfortunately,
target keeps moving and so it's just an answer today may not be the answer tomorrow. And that's why it's great that it's a podcast gives you an opportunity to be really relevant and timely with that. And again, from your vantage point, Great insight in both future opportunities and potential problems.

see now that's a perfect example , of an issue that's constantly in flux and a lot of companies are trying to position himself. So they're in the right place when it saddles. And there was a great. Yeah. Nolan, Jackson is one of my colleagues. And you mentioned the law, what is the law?
There is the federal law, but then there are 50 state laws. And when we're talking about Delta eight, it seems like every state was doing it differently. So , for companies that want to sell their products across state lines or sell them in all 50 states, it can be a real legal and [00:04:00] regulatory challenge.
We're trying to. You have folks that kind of advice, they need to be able to deal with that change. I'm sure there are some other potential third rail topics. Any of them you plan to cover? Oh yeah. We did Delta eight next an episode coming up is about other novel cannabinoids.
So. We're hearing about Delta 10 there's something called H H C. There is THC acetates and these products, the more and more intoxicating they get the more the developments are. And so really I, I'm getting a lot of clients wondering, can I do this? Is it legal? And the first answer I have to give them is maybe because.
This law is so, unclear right now. And when I was working on the 2018 farm bill, we were familiar with Delta nine, THC, never heard of Delta eight or Delta 10 or anything like that. And so, as the laws adapt and the regulations adapt I'm hopeful, my podcast , can help keep people up to date [00:05:00] on what's happening out there.
Well, it certainly helps to have access to subject matter experts from your hemp team at frost brown, Todd, I mean, that's gotta be a huge advantage. Do you intend to have your colleagues as guest on the show? Yeah, , I'm starting out the podcast with episodes having conversations with my colleagues.
Nolan was a Delta aid expert. Kimra hall is our FDA labeling expert. Alan McDonald has been a an expert in raising money for startup companies. Marty rose, who has been defending class action lawsuits for decades and , got four recent hemp and CBD ones dismissed.
And so th that's how we're going to start. I think at some point we'll expand this and maybe I'll , bring in some of our members of Congress that we work with agency officials and try to get their perspectives on these issues as well.
So just think about this. You're getting really cutting edge expert information from the people at night. And for free, it's a great meal. [00:06:00] Yeah, no, no. We we, we provide a public service, but as you'll listen to these programs, you'll realize that we're really just kind of covering the surface of these issues and we're not providing legal advice.
We don't want people to listen and say, okay, Do this they, they should w dig into details, finding an attorney, maybe maybe our firm may be a local firm, but when you're in this new area and the laws are still gray having a legal counsel is just , so important.
Sometimes you don't even know where to start. That's why I think you start with a podcast. You listen to the episode, then you follow up. If you feel like you need to, you mentioned members of Congress, we also have. Industry. Guests. Yeah. Now , we're just scratching the surface now, but we'll see how this goes.
